2013年國(guó)家知識(shí)產(chǎn)權(quán)戰(zhàn)略實(shí)施推進(jìn)計(jì)劃(中英文)

 
 
為貫徹黨的十八大精神,落實(shí)創(chuàng)新驅(qū)動(dòng)發(fā)展戰(zhàn)略,推動(dòng)實(shí)現(xiàn)《國(guó)家知識(shí)產(chǎn)權(quán)戰(zhàn)略綱要》五年目標(biāo),明確2013年戰(zhàn)略實(shí)施重點(diǎn)任務(wù)和工作措施,制定本計(jì)劃。

一、提升知識(shí)產(chǎn)權(quán)創(chuàng)造水平

目標(biāo)任務(wù):提高知識(shí)產(chǎn)權(quán)質(zhì)量和創(chuàng)造效率,改進(jìn)專(zhuān)利、商標(biāo)、版權(quán)、植物新品種等知識(shí)產(chǎn)權(quán)審查管理工作,完善知識(shí)產(chǎn)權(quán)考核評(píng)價(jià)體系,引導(dǎo)知識(shí)產(chǎn)權(quán)創(chuàng)造主體從注重知識(shí)產(chǎn)權(quán)數(shù)量向注重知識(shí)產(chǎn)權(quán)質(zhì)量轉(zhuǎn)變,促進(jìn)提升知識(shí)產(chǎn)權(quán)價(jià)值。

工作措施:

1.落實(shí)修訂后的國(guó)家技術(shù)發(fā)明獎(jiǎng)評(píng)價(jià)指標(biāo)體系,完善對(duì)候選項(xiàng)目申報(bào)材料知識(shí)產(chǎn)權(quán)證明文件的要求,引導(dǎo)專(zhuān)家加強(qiáng)對(duì)候選項(xiàng)目知識(shí)產(chǎn)權(quán)質(zhì)量及轉(zhuǎn)化運(yùn)用情況的評(píng)價(jià)。

2.完善專(zhuān)利指標(biāo)考核評(píng)價(jià)體系和知識(shí)產(chǎn)權(quán)統(tǒng)計(jì)指標(biāo)體系;開(kāi)展“每萬(wàn)人口發(fā)明專(zhuān)利擁有量指標(biāo)”考核評(píng)價(jià)。

3.完善專(zhuān)利審查業(yè)務(wù)指導(dǎo)體系和質(zhì)量保障體系,促進(jìn)提高檢索能力;制定提升專(zhuān)利質(zhì)量促進(jìn)政策,明確專(zhuān)利資助政策導(dǎo)向,提高專(zhuān)利資助效能;加強(qiáng)對(duì)非正常專(zhuān)利申請(qǐng)的監(jiān)控和處理,規(guī)范專(zhuān)利申請(qǐng)行為。

4.完善商標(biāo)審查審理標(biāo)準(zhǔn),完成商標(biāo)注冊(cè)與管理自動(dòng)化三期系統(tǒng)建設(shè),提升商標(biāo)注冊(cè)效能,確保商標(biāo)注冊(cè)審查周期保持在10個(gè)月,異議審理周期保持在18個(gè)月。

5.加大作品登記工作力度,完善作品登記數(shù)據(jù)統(tǒng)計(jì)、報(bào)送和公布制度,擴(kuò)大作品登記數(shù)量和覆蓋面。

6.制定和完善植物新品種測(cè)試指南和審批規(guī)則,強(qiáng)化審查測(cè)試能力建設(shè),提升植物新品種審查管理水平,提高品種授權(quán)質(zhì)量。

二、強(qiáng)化重點(diǎn)產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)布局

目標(biāo)任務(wù):促進(jìn)知識(shí)產(chǎn)權(quán)政策與產(chǎn)業(yè)政策深度融合,加強(qiáng)戰(zhàn)略性新興產(chǎn)業(yè)、區(qū)域特色優(yōu)勢(shì)產(chǎn)業(yè)等的知識(shí)產(chǎn)權(quán)風(fēng)險(xiǎn)評(píng)估和預(yù)警,加大重點(diǎn)產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)布局引導(dǎo)力度,引導(dǎo)產(chǎn)業(yè)企業(yè)提高利用知識(shí)產(chǎn)權(quán)參與國(guó)際競(jìng)爭(zhēng)的能力。

工作措施:

7.貫徹落實(shí)國(guó)務(wù)院辦公廳《關(guān)于加強(qiáng)戰(zhàn)略性新興產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)工作的若干意見(jiàn)》,完善工作協(xié)同機(jī)制,制定實(shí)施2013年戰(zhàn)略性新興產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)工作計(jì)劃。

8.落實(shí)《發(fā)明專(zhuān)利申請(qǐng)優(yōu)先審查管理辦法》,面向節(jié)能環(huán)保、新一代信息技術(shù)、生物、高端裝備制造、新能源、新材料等戰(zhàn)略性新興產(chǎn)業(yè)技術(shù)領(lǐng)域,以及低碳技術(shù)、節(jié)約資源等有助于綠色發(fā)展的專(zhuān)利申請(qǐng),開(kāi)展優(yōu)先審查工作。

9.完善版權(quán)統(tǒng)計(jì)制度,開(kāi)展年度版權(quán)相關(guān)產(chǎn)業(yè)對(duì)國(guó)民經(jīng)濟(jì)貢獻(xiàn)調(diào)研工作,加強(qiáng)對(duì)版權(quán)交易活動(dòng)的指導(dǎo)和管理。

10.探索國(guó)家層面知識(shí)產(chǎn)權(quán)評(píng)議制度機(jī)制建設(shè),面向中央企業(yè)、科研院所和地方,深化重大經(jīng)濟(jì)科技活動(dòng)知識(shí)產(chǎn)權(quán)評(píng)議試點(diǎn),提升知識(shí)產(chǎn)權(quán)分析評(píng)議服務(wù)能力。

11.深入開(kāi)展“產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)風(fēng)險(xiǎn)評(píng)估與預(yù)警工程”,選取產(chǎn)業(yè)轉(zhuǎn)型升級(jí)亟需的重點(diǎn)產(chǎn)業(yè)開(kāi)展知識(shí)產(chǎn)權(quán)預(yù)警,針對(duì)關(guān)鍵技術(shù)領(lǐng)域進(jìn)行知識(shí)產(chǎn)權(quán)跟蹤分析,在重點(diǎn)產(chǎn)業(yè)推動(dòng)知識(shí)產(chǎn)權(quán)市場(chǎng)化運(yùn)營(yíng)。

12.選擇若干產(chǎn)業(yè)開(kāi)展專(zhuān)利導(dǎo)航產(chǎn)業(yè)發(fā)展和專(zhuān)利布局試點(diǎn);組織開(kāi)展10項(xiàng)重點(diǎn)領(lǐng)域、重大技術(shù)的專(zhuān)利分析預(yù)警項(xiàng)目;組織開(kāi)展10項(xiàng)面向產(chǎn)業(yè)的專(zhuān)利分析普及推廣課題研究,修訂《專(zhuān)利分析實(shí)務(wù)手冊(cè)》,制定《專(zhuān)利分析報(bào)告標(biāo)準(zhǔn)》。

三、促進(jìn)知識(shí)產(chǎn)權(quán)運(yùn)用

目標(biāo)任務(wù):強(qiáng)化企業(yè)知識(shí)產(chǎn)權(quán)運(yùn)用主體地位,完善以知識(shí)產(chǎn)權(quán)為紐帶和核心的創(chuàng)新成果轉(zhuǎn)化運(yùn)用機(jī)制,實(shí)施促進(jìn)知識(shí)產(chǎn)權(quán)向企業(yè)順暢轉(zhuǎn)移轉(zhuǎn)化的政策措施,推動(dòng)知識(shí)產(chǎn)權(quán)成果產(chǎn)品化、商品化和產(chǎn)業(yè)化。

工作措施:

13.組織實(shí)施若干重大產(chǎn)業(yè)創(chuàng)新發(fā)展工程和應(yīng)用示范工程,推進(jìn)下一代互聯(lián)網(wǎng)規(guī)模商用、LTE產(chǎn)業(yè)發(fā)展等方面具有自主知識(shí)產(chǎn)權(quán)成果的產(chǎn)品化、商品化和產(chǎn)業(yè)化,促進(jìn)數(shù)字電視、新一代移動(dòng)通信、下一代互聯(lián)網(wǎng)等領(lǐng)域知識(shí)產(chǎn)權(quán)與標(biāo)準(zhǔn)化工作的結(jié)合。

14.研究制定促進(jìn)科研機(jī)構(gòu)和高等學(xué)校技術(shù)轉(zhuǎn)移工作的指導(dǎo)意見(jiàn),以技術(shù)轉(zhuǎn)移示范機(jī)構(gòu)為試點(diǎn),推動(dòng)科研機(jī)構(gòu)與高等學(xué)校建立規(guī)范化的知識(shí)產(chǎn)權(quán)管理制度和技術(shù)轉(zhuǎn)移機(jī)制。

15.全面推進(jìn)“工業(yè)企業(yè)知識(shí)產(chǎn)權(quán)運(yùn)用能力培育工程”,通過(guò)認(rèn)定、項(xiàng)目扶持和獎(jiǎng)勵(lì)等方式支持各地培育工程開(kāi)展,研究制定《工業(yè)企業(yè)知識(shí)產(chǎn)權(quán)管理指南》,為試點(diǎn)企業(yè)開(kāi)展知識(shí)產(chǎn)權(quán)管理提供指導(dǎo)。

16.組織實(shí)施林業(yè)專(zhuān)利、授權(quán)新品種產(chǎn)業(yè)化推進(jìn)計(jì)劃,促進(jìn)一批先進(jìn)林業(yè)專(zhuān)利和優(yōu)良新品種轉(zhuǎn)化應(yīng)用。

17.加快軍民結(jié)合知識(shí)產(chǎn)權(quán)雙向轉(zhuǎn)移,啟動(dòng)建立立項(xiàng)論證知識(shí)產(chǎn)權(quán)管理制度,裝備采購(gòu)技術(shù)資料權(quán)交付、使用與管理制度,以及軍用軟件著作權(quán)管理制度,創(chuàng)新知識(shí)產(chǎn)權(quán)轉(zhuǎn)移轉(zhuǎn)化模式,推動(dòng)國(guó)防知識(shí)產(chǎn)權(quán)運(yùn)用。

18.完善知識(shí)產(chǎn)權(quán)投融資相關(guān)政策,制定商業(yè)銀行知識(shí)產(chǎn)權(quán)質(zhì)押貸款業(yè)務(wù)指導(dǎo)意見(jiàn),搭建20個(gè)知識(shí)產(chǎn)權(quán)投融資服務(wù)平臺(tái),開(kāi)展知識(shí)產(chǎn)權(quán)許可權(quán)、股權(quán)與其他資產(chǎn)組合的新模式試點(diǎn)工作。

四、加強(qiáng)知識(shí)產(chǎn)權(quán)保護(hù)

目標(biāo)任務(wù):完善知識(shí)產(chǎn)權(quán)相關(guān)法律法規(guī),健全依法打擊侵犯知識(shí)產(chǎn)權(quán)的長(zhǎng)效機(jī)制,開(kāi)展知識(shí)產(chǎn)權(quán)保護(hù)績(jī)效考核。提升知識(shí)產(chǎn)權(quán)司法保護(hù)效能,提高行政執(zhí)法能力,針對(duì)重點(diǎn)領(lǐng)域、重點(diǎn)產(chǎn)業(yè)開(kāi)展專(zhuān)項(xiàng)保護(hù)和維權(quán)援助工作,推動(dòng)知識(shí)產(chǎn)權(quán)行政處罰案件信息依法公開(kāi)。加強(qiáng)對(duì)傳統(tǒng)優(yōu)勢(shì)領(lǐng)域知識(shí)產(chǎn)權(quán)資源的保護(hù),提升國(guó)際應(yīng)對(duì)水平。

工作措施:

19.積極推進(jìn)商標(biāo)法、著作權(quán)法、專(zhuān)利法及相關(guān)實(shí)施條例的修改工作。

20.加強(qiáng)創(chuàng)新藥物保護(hù),開(kāi)展針對(duì)創(chuàng)新藥物保護(hù)的政策和立法研究。

21.起草發(fā)布《互聯(lián)網(wǎng)傳播影視作品著作權(quán)監(jiān)督管理辦法》、《版權(quán)執(zhí)法指導(dǎo)意見(jiàn)》。

22.修改《關(guān)于審理專(zhuān)利糾紛案件適用法律問(wèn)題的若干規(guī)定》(2001),制定《關(guān)于知識(shí)產(chǎn)權(quán)訴前保全適用法律若干問(wèn)題的解釋》、《關(guān)于審理商標(biāo)民事糾紛案件適用法律若干問(wèn)題的解釋》、《關(guān)于審理商標(biāo)授權(quán)確權(quán)案件適用法律若干問(wèn)題的解釋》;及時(shí)出臺(tái)專(zhuān)利侵權(quán)糾紛法律適用問(wèn)題、專(zhuān)利授權(quán)確權(quán)問(wèn)題、馳名商標(biāo)保護(hù)、服務(wù)商標(biāo)保護(hù)、商業(yè)秘密保護(hù)、涉卡拉OK經(jīng)營(yíng)者著作權(quán)糾紛法律適用問(wèn)題等指導(dǎo)性意見(jiàn)。

23.適當(dāng)增加具有一般知識(shí)產(chǎn)權(quán)案件管轄權(quán)的基層法院數(shù)量,增加指定部分中級(jí)人民法院管轄第一審專(zhuān)利糾紛案件,深化知識(shí)產(chǎn)權(quán)審判庭集中審理知識(shí)產(chǎn)權(quán)民事、行政和刑事案件試點(diǎn),優(yōu)化審判協(xié)調(diào)機(jī)制;完善基層法院知識(shí)產(chǎn)權(quán)審判業(yè)務(wù)機(jī)構(gòu)設(shè)置,實(shí)施名牌法院工程。

24.開(kāi)展地方政府打擊侵權(quán)假冒績(jī)效考核工作,制定地方政府打擊侵權(quán)假冒工作績(jī)效考核辦法。

25.制定打擊侵權(quán)假冒行政處罰案件依法公開(kāi)的指導(dǎo)文件,推動(dòng)有關(guān)行政執(zhí)法機(jī)關(guān)依法公開(kāi)相關(guān)案件信息。

26.繼續(xù)積極推動(dòng)“兩法銜接”工作機(jī)制不斷完善,在年底前完成信息共享平臺(tái)建設(shè),并監(jiān)督行政執(zhí)法機(jī)關(guān)移送一批涉嫌犯罪案件。

27.督導(dǎo)全國(guó)地市、縣級(jí)政府機(jī)關(guān)按期于2013年年底前完成使用正版軟件檢查整改工作,全面推進(jìn)企業(yè)使用正版軟件工作,完成企業(yè)軟件資產(chǎn)管理試點(diǎn)。

28.做好新出廠(chǎng)計(jì)算機(jī)預(yù)裝正版操作系統(tǒng)監(jiān)督管理工作,加強(qiáng)推廣安全可控正版軟件的推廣應(yīng)用,促進(jìn)政府機(jī)關(guān)軟件正版化工作與信息化工作結(jié)合。

29.組織開(kāi)展打假行動(dòng),重點(diǎn)打擊危害企業(yè)創(chuàng)新發(fā)展、危害擴(kuò)大內(nèi)需和職工就業(yè)、危害人民群眾生命健康、危害生產(chǎn)生活安全、危害糧食安全和農(nóng)民利益等五類(lèi)犯罪。

30.查處侵權(quán)和傳播制售假冒偽劣商品信息的網(wǎng)站,曝光違法違規(guī)接入企業(yè),研究有效措施加強(qiáng)域名信息監(jiān)管,提高互聯(lián)網(wǎng)站備案信息準(zhǔn)確率。

31.開(kāi)展第九次打擊網(wǎng)絡(luò)侵權(quán)盜版“劍網(wǎng)行動(dòng)”,針對(duì)網(wǎng)絡(luò)文學(xué)、音頻、視頻、游戲、動(dòng)漫、軟件等侵權(quán)盜版開(kāi)展專(zhuān)項(xiàng)治理。

32.加強(qiáng)網(wǎng)絡(luò)版權(quán)主動(dòng)監(jiān)管,重點(diǎn)開(kāi)展對(duì)應(yīng)用軟件網(wǎng)站、購(gòu)物網(wǎng)站和視頻網(wǎng)站的版權(quán)主動(dòng)監(jiān)管。

33.啟動(dòng)實(shí)施“專(zhuān)利執(zhí)法能力提升工程”,推進(jìn)建立執(zhí)法隊(duì)、專(zhuān)利侵權(quán)判定咨詢(xún)中心、專(zhuān)利行政執(zhí)法工作協(xié)調(diào)中心,出臺(tái)落實(shí)《關(guān)于加強(qiáng)專(zhuān)利行政執(zhí)法工作的決定》的具體意見(jiàn),建立執(zhí)法工作目標(biāo)責(zé)任制,推動(dòng)和保障專(zhuān)利行政執(zhí)法能力提升。

34.深入推進(jìn)專(zhuān)業(yè)市場(chǎng)知識(shí)產(chǎn)權(quán)保護(hù)工作,推動(dòng)出臺(tái)加強(qiáng)專(zhuān)業(yè)市場(chǎng)知識(shí)產(chǎn)權(quán)保護(hù)的相關(guān)意見(jiàn),推進(jìn)專(zhuān)業(yè)市場(chǎng)知識(shí)產(chǎn)權(quán)保護(hù)能力提升工作;建立健全行業(yè)知識(shí)產(chǎn)權(quán)保護(hù)自律機(jī)制,支持行業(yè)協(xié)會(huì)開(kāi)展知識(shí)產(chǎn)權(quán)保護(hù)工作。

35.圍繞重點(diǎn)領(lǐng)域、重點(diǎn)產(chǎn)業(yè)建立一批知識(shí)產(chǎn)權(quán)快速維權(quán)中心,建立快速維權(quán)工作機(jī)制,高效服務(wù)企業(yè)和產(chǎn)業(yè),探索建立專(zhuān)利侵權(quán)判定咨詢(xún)中心。

36.完善商標(biāo)侵權(quán)假冒行為專(zhuān)項(xiàng)整治制度,推動(dòng)建立商標(biāo)行政執(zhí)法信息共享平臺(tái),組織開(kāi)展專(zhuān)項(xiàng)行動(dòng),以馳名商標(biāo)、涉外商標(biāo)、地理標(biāo)志為重點(diǎn),督辦一批大案要案,加大對(duì)擅自使用知名商品特有名稱(chēng)包裝裝潢等“傍名牌”行為的查處力度。

37.健全商標(biāo)保護(hù)長(zhǎng)效機(jī)制,抓緊制定在全國(guó)大中城市大型零售商業(yè)企業(yè)、知名品牌專(zhuān)賣(mài)店推廣商標(biāo)授權(quán)經(jīng)營(yíng)制度的方案,提升日常監(jiān)管效能。

38.加強(qiáng)知識(shí)產(chǎn)權(quán)海關(guān)保護(hù),針對(duì)重點(diǎn)領(lǐng)域、重點(diǎn)商品開(kāi)展專(zhuān)項(xiàng)執(zhí)法行動(dòng),深化海關(guān)間執(zhí)法合作,共同打擊國(guó)際貿(mào)易中的侵權(quán)違法行為,加大知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)的科技投入,提升執(zhí)法效能。

39.開(kāi)展知識(shí)產(chǎn)權(quán)領(lǐng)域多雙邊交流與合作,做好牽頭和參與知識(shí)產(chǎn)權(quán)多雙邊談判相關(guān)工作,推進(jìn)《中歐地理標(biāo)志協(xié)定》談判,密切關(guān)注和參與知識(shí)產(chǎn)權(quán)領(lǐng)域的國(guó)際規(guī)則制定,積極宣傳我國(guó)在知識(shí)產(chǎn)權(quán)保護(hù)領(lǐng)域的發(fā)展成就。

40.加強(qiáng)對(duì)企業(yè)涉外知識(shí)產(chǎn)權(quán)案件的應(yīng)訴指導(dǎo),充分發(fā)揮企業(yè)知識(shí)產(chǎn)權(quán)海外維權(quán)援助中心作用;加強(qiáng)我出口貿(mào)易主要產(chǎn)業(yè)和相關(guān)企業(yè)“走出去”的知識(shí)產(chǎn)權(quán)風(fēng)險(xiǎn)評(píng)估和預(yù)警。

41.積極推進(jìn)我國(guó)加入世界知識(shí)產(chǎn)權(quán)組織(WIPO)管理的外觀(guān)設(shè)計(jì)海牙體系相關(guān)工作。

42.加強(qiáng)林業(yè)植物新品種保護(hù),啟動(dòng)建設(shè)月季等林業(yè)植物新品種DNA圖譜數(shù)據(jù)庫(kù),為品種權(quán)執(zhí)法提供技術(shù)支撐。

43.做好地理標(biāo)志和農(nóng)產(chǎn)品商標(biāo)注冊(cè)保護(hù)工作,推進(jìn)實(shí)施“商標(biāo)富農(nóng)”工程,促進(jìn)新農(nóng)村建設(shè)。

44.推進(jìn)地理標(biāo)志保護(hù)示范區(qū)建設(shè),增強(qiáng)地理標(biāo)志產(chǎn)品的進(jìn)出口保護(hù)監(jiān)管與實(shí)效,推動(dòng)地理標(biāo)志產(chǎn)品進(jìn)出口貿(mào)易和產(chǎn)業(yè)國(guó)際化發(fā)展。

45.調(diào)查和挖掘農(nóng)產(chǎn)品地理標(biāo)志資源,開(kāi)展農(nóng)產(chǎn)品地理標(biāo)志獲證產(chǎn)品質(zhì)量安全狀況跟蹤監(jiān)測(cè)工作。

46.推動(dòng)《生物遺傳資源獲取和惠益分享管理?xiàng)l例》立法進(jìn)程,制定生物遺傳資源獲取與惠益分享管理相關(guān)政策和制度。

47.啟動(dòng)“中醫(yī)藥傳統(tǒng)知識(shí)保護(hù)技術(shù)研究”項(xiàng)目,推動(dòng)建立中醫(yī)藥傳統(tǒng)知識(shí)技術(shù)規(guī)范,調(diào)查摸底中醫(yī)藥傳統(tǒng)知識(shí)資源,為立檔和編制中醫(yī)藥傳統(tǒng)知識(shí)保護(hù)名錄提供素材。

48.開(kāi)展“民族民間文藝知識(shí)產(chǎn)權(quán)保護(hù)研究”項(xiàng)目,將知識(shí)產(chǎn)權(quán)保護(hù)管理內(nèi)容納入中國(guó)民間文藝基礎(chǔ)資源管理系統(tǒng),形成可操作的中國(guó)民間文學(xué)數(shù)據(jù)庫(kù)的知識(shí)產(chǎn)權(quán)解決方案。

五、提升知識(shí)產(chǎn)權(quán)管理能力

目標(biāo)任務(wù):制定加強(qiáng)知識(shí)產(chǎn)權(quán)管理政策,完善知識(shí)產(chǎn)權(quán)管理體系和統(tǒng)籌協(xié)調(diào)機(jī)制,加強(qiáng)知識(shí)產(chǎn)權(quán)協(xié)同管理、規(guī)范管理、主動(dòng)管理,提升知識(shí)產(chǎn)權(quán)管理效能,提高各類(lèi)主體的知識(shí)產(chǎn)權(quán)科學(xué)管理能力和水平。

工作措施:

49.制定加強(qiáng)知識(shí)產(chǎn)權(quán)管理的政策文件,完善知識(shí)產(chǎn)權(quán)管理體制機(jī)制,提高政府、行業(yè)、企業(yè)、高校、科研機(jī)構(gòu)和服務(wù)機(jī)構(gòu)等的知識(shí)產(chǎn)權(quán)管理水平。

50.研究修訂高校知識(shí)產(chǎn)權(quán)管理相關(guān)政策文件,完善高校知識(shí)產(chǎn)權(quán)管理體系,提升高校知識(shí)產(chǎn)權(quán)管理能力。

51.落實(shí)《國(guó)家科技重大專(zhuān)項(xiàng)知識(shí)產(chǎn)權(quán)管理暫行規(guī)定》,推動(dòng)各專(zhuān)項(xiàng)加快制定符合本專(zhuān)項(xiàng)特點(diǎn)的知識(shí)產(chǎn)權(quán)管理細(xì)則,完善國(guó)家科技重大專(zhuān)項(xiàng)知識(shí)產(chǎn)權(quán)信息登記、統(tǒng)計(jì)和評(píng)估制度,強(qiáng)化監(jiān)督評(píng)估和指導(dǎo)。

52.完善《關(guān)于加強(qiáng)國(guó)家科技計(jì)劃知識(shí)產(chǎn)權(quán)管理工作的規(guī)定》,吸收知識(shí)產(chǎn)權(quán)專(zhuān)家參與國(guó)家科技計(jì)劃項(xiàng)目驗(yàn)收評(píng)估,加強(qiáng)國(guó)家科技計(jì)劃重點(diǎn)領(lǐng)域知識(shí)產(chǎn)權(quán)統(tǒng)計(jì)評(píng)估,強(qiáng)化科技計(jì)劃項(xiàng)目成果信息發(fā)布。

53.加強(qiáng)轉(zhuǎn)基因生物新品種培育重大專(zhuān)項(xiàng)知識(shí)產(chǎn)權(quán)管理,研究起草相關(guān)知識(shí)產(chǎn)權(quán)管理辦法,為我國(guó)轉(zhuǎn)基因生物技術(shù)研發(fā)、產(chǎn)業(yè)化運(yùn)用提供知識(shí)產(chǎn)權(quán)的規(guī)范性指引。

54.研究制定文化系統(tǒng)實(shí)施知識(shí)產(chǎn)權(quán)戰(zhàn)略的指導(dǎo)性文件,加強(qiáng)對(duì)全國(guó)文化系統(tǒng)知識(shí)產(chǎn)權(quán)工作的指導(dǎo)。

55.創(chuàng)新商標(biāo)行政指導(dǎo)工作機(jī)制,建立商標(biāo)戰(zhàn)略實(shí)施分類(lèi)指導(dǎo)制度,鼓勵(lì)和指導(dǎo)市場(chǎng)主體結(jié)合自身發(fā)展要求制定實(shí)施商標(biāo)戰(zhàn)略。

56.完善廣播影視知識(shí)產(chǎn)權(quán)管理機(jī)制,加強(qiáng)廣播影視法律風(fēng)險(xiǎn)防范,推動(dòng)各級(jí)廣播電臺(tái)電視臺(tái)建立知識(shí)產(chǎn)權(quán)管理規(guī)范,重點(diǎn)推廣廣播電臺(tái)、電視臺(tái)版權(quán)合同示范文本,推進(jìn)廣播電臺(tái)、電視臺(tái)媒體資產(chǎn)管理系統(tǒng)建設(shè)項(xiàng)目,指導(dǎo)中國(guó)廣播電視協(xié)會(huì)廣播、電視版權(quán)委員會(huì)加強(qiáng)行業(yè)自律,完善會(huì)員爭(zhēng)議內(nèi)部調(diào)解及行業(yè)集體維權(quán)機(jī)制。

57.起草頒布《教科書(shū)法定許可付酬辦法》,修訂頒布《出版文字作品報(bào)酬規(guī)定》。

58.對(duì)著作權(quán)集體管理組織加強(qiáng)監(jiān)督管理并制定實(shí)施具體制度,推動(dòng)其公開(kāi)、透明、依法開(kāi)展工作。

59.開(kāi)展出版業(yè)版權(quán)資產(chǎn)管理試點(diǎn),著手進(jìn)行版權(quán)資產(chǎn)管理體系和制度研究,研究起草指導(dǎo)文化企業(yè)版權(quán)資產(chǎn)管理的文件。

60.發(fā)布《企業(yè)知識(shí)產(chǎn)權(quán)管理規(guī)范》國(guó)家標(biāo)準(zhǔn),制定知識(shí)產(chǎn)權(quán)(專(zhuān)利)優(yōu)勢(shì)企業(yè)認(rèn)定辦法,選擇部分省份開(kāi)展知識(shí)產(chǎn)權(quán)優(yōu)勢(shì)企業(yè)培育工作。

61.研究制定中科院知識(shí)產(chǎn)權(quán)管理標(biāo)準(zhǔn)或工作指南,進(jìn)一步規(guī)范科研單位知識(shí)產(chǎn)權(quán)管理工作;起草制定中科院《科研項(xiàng)目知識(shí)產(chǎn)權(quán)管理辦法》,深入推進(jìn)重大科研項(xiàng)目知識(shí)產(chǎn)權(quán)全過(guò)程管理試點(diǎn)工作。

62.完善國(guó)防知識(shí)產(chǎn)權(quán)工作體系,引導(dǎo)國(guó)防知識(shí)產(chǎn)權(quán)分析和科學(xué)布局,開(kāi)展創(chuàng)新主體知識(shí)產(chǎn)權(quán)綜合管理試點(diǎn),加強(qiáng)裝備采購(gòu)合同知識(shí)產(chǎn)權(quán)管理,著手發(fā)明報(bào)告制度建設(shè)。

63.通過(guò)“高層次留學(xué)人才回國(guó)資助”、“留學(xué)人員科技活動(dòng)項(xiàng)目擇優(yōu)資助”、“海外赤子為國(guó)服務(wù)行動(dòng)計(jì)劃”等引才計(jì)劃,重點(diǎn)引進(jìn)實(shí)施知識(shí)產(chǎn)權(quán)戰(zhàn)略急需緊缺的海外高端留學(xué)人才;結(jié)合留學(xué)人員回國(guó)創(chuàng)業(yè)啟動(dòng)支持計(jì)劃,重點(diǎn)支持留學(xué)人才以自主知識(shí)產(chǎn)權(quán)創(chuàng)辦高新技術(shù)企業(yè);完善高層次人才回國(guó)各項(xiàng)優(yōu)惠政策,為引進(jìn)知識(shí)產(chǎn)權(quán)高端人才并使其發(fā)揮作用創(chuàng)造良好的環(huán)境。

64.研究制定《加強(qiáng)知識(shí)產(chǎn)權(quán)人才體系建設(shè)的意見(jiàn)》;實(shí)施“百千萬(wàn)知識(shí)產(chǎn)權(quán)人才”工程,開(kāi)展百名高層次人才培養(yǎng)人選的考核工作,繼續(xù)加大對(duì)千名、萬(wàn)名專(zhuān)業(yè)人才的培養(yǎng);實(shí)施國(guó)家知識(shí)產(chǎn)權(quán)培訓(xùn)基地建設(shè)工程,制定《關(guān)于加強(qiáng)國(guó)家知識(shí)產(chǎn)權(quán)培訓(xùn)基地工作的意見(jiàn)》;實(shí)施知識(shí)產(chǎn)權(quán)人才信息化工程。

六、發(fā)展知識(shí)產(chǎn)權(quán)服務(wù)業(yè)

目標(biāo)任務(wù):健全知識(shí)產(chǎn)權(quán)服務(wù)業(yè)管理體系,落實(shí)相關(guān)政策,加強(qiáng)知識(shí)產(chǎn)權(quán)基礎(chǔ)信息資源建設(shè)與開(kāi)發(fā)利用,引導(dǎo)知識(shí)產(chǎn)權(quán)服務(wù)機(jī)構(gòu)拓展業(yè)務(wù)范圍,加快培養(yǎng)知識(shí)產(chǎn)權(quán)服務(wù)高端人才,培育和促進(jìn)知識(shí)產(chǎn)權(quán)服務(wù)業(yè)發(fā)展。

工作措施:

65.落實(shí)《關(guān)于加快培育和發(fā)展知識(shí)產(chǎn)權(quán)服務(wù)業(yè)的指導(dǎo)意見(jiàn)》,出臺(tái)配套政策,建立知識(shí)產(chǎn)權(quán)服務(wù)業(yè)統(tǒng)計(jì)監(jiān)測(cè)和信息發(fā)布機(jī)制,推進(jìn)知識(shí)產(chǎn)權(quán)服務(wù)業(yè)集聚區(qū)建設(shè),培育知識(shí)產(chǎn)權(quán)服務(wù)品牌機(jī)構(gòu)。

66.組織實(shí)施高技術(shù)服務(wù)業(yè)專(zhuān)項(xiàng),將知識(shí)產(chǎn)權(quán)服務(wù)業(yè)作為重點(diǎn)支持領(lǐng)域和方向。

67.推動(dòng)《專(zhuān)利代理?xiàng)l例》修訂工作,推進(jìn)專(zhuān)利代理行業(yè)發(fā)展促進(jìn)工程和試點(diǎn)工作,全面開(kāi)展專(zhuān)利代理人實(shí)務(wù)技能培訓(xùn)。

68.落實(shí)《律師事務(wù)所從事商標(biāo)代理業(yè)務(wù)管理辦法》,做好律師事務(wù)所從事商標(biāo)代理業(yè)務(wù)的備案等相關(guān)工作,加強(qiáng)對(duì)律師商標(biāo)代理業(yè)務(wù)的監(jiān)督管理,推動(dòng)商標(biāo)法律服務(wù)規(guī)范化。

69.扶持、拓展律師開(kāi)展專(zhuān)利代理法律服務(wù),在專(zhuān)利代理行業(yè)開(kāi)展專(zhuān)利律師試點(diǎn)工作,著力在兩個(gè)行業(yè)中培育、發(fā)展專(zhuān)利律師隊(duì)伍,做大做強(qiáng)專(zhuān)利法律服務(wù)。

70.推動(dòng)版權(quán)示范城市、示范單位、示范園區(qū)(基地)建設(shè),加強(qiáng)對(duì)版權(quán)交易活動(dòng)的指導(dǎo)和管理,支持有關(guān)機(jī)構(gòu)開(kāi)展版權(quán)爭(zhēng)議調(diào)解、仲裁工作。

71.推動(dòng)將知識(shí)產(chǎn)權(quán)司法鑒定納入統(tǒng)一登記管理,細(xì)化知識(shí)產(chǎn)權(quán)司法鑒定執(zhí)業(yè)分類(lèi),完善知識(shí)產(chǎn)權(quán)司法鑒定技術(shù)規(guī)范和標(biāo)準(zhǔn)體系,進(jìn)一步提高知識(shí)產(chǎn)權(quán)司法鑒定的規(guī)范化水平和執(zhí)業(yè)能力,扶持、培養(yǎng)一批高資質(zhì)、高水平的知識(shí)產(chǎn)權(quán)司法鑒定機(jī)構(gòu)。

72.擴(kuò)大專(zhuān)利保險(xiǎn)試點(diǎn)地區(qū)規(guī)模,開(kāi)發(fā)專(zhuān)利保險(xiǎn)險(xiǎn)種,構(gòu)建多方共同參與的專(zhuān)利保險(xiǎn)服務(wù)創(chuàng)新機(jī)制。

73.落實(shí)全國(guó)專(zhuān)利信息公共服務(wù)體系建設(shè)規(guī)劃,建立全國(guó)專(zhuān)利信息傳播利用的宏觀(guān)管理與業(yè)務(wù)指導(dǎo)體系,支持地方開(kāi)展特色產(chǎn)業(yè)專(zhuān)利信息服務(wù)工作。

74.構(gòu)建行業(yè)知識(shí)產(chǎn)權(quán)綜合數(shù)據(jù)平臺(tái),建設(shè)半導(dǎo)體照明、新能源汽車(chē)等重點(diǎn)領(lǐng)域?qū)@芯糠治霭咐龓?kù),軟件著作權(quán)、集成電路布圖設(shè)計(jì)等信息數(shù)據(jù)庫(kù)和重點(diǎn)產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)預(yù)警數(shù)據(jù)庫(kù)。

七、加強(qiáng)知識(shí)產(chǎn)權(quán)文化建設(shè)

目標(biāo)任務(wù):加強(qiáng)知識(shí)產(chǎn)權(quán)宣傳普及、人才培養(yǎng)、學(xué)科教育工作,營(yíng)造尊重知識(shí)、崇尚創(chuàng)新、誠(chéng)信守法的知識(shí)產(chǎn)權(quán)文化氛圍。加強(qiáng)知識(shí)產(chǎn)權(quán)對(duì)文化產(chǎn)業(yè)的支持力度,支持新聞出版、廣播影視、文學(xué)藝術(shù)等重要領(lǐng)域的知識(shí)產(chǎn)權(quán)集成與發(fā)展,促進(jìn)文化產(chǎn)業(yè)快速繁榮發(fā)展。

工作措施:

75.推進(jìn)知識(shí)產(chǎn)權(quán)文化建設(shè)工程,出臺(tái)《加強(qiáng)知識(shí)產(chǎn)權(quán)文化建設(shè)工作的指導(dǎo)意見(jiàn)》。

76.大力宣傳黨的十八大關(guān)于實(shí)施知識(shí)產(chǎn)權(quán)戰(zhàn)略、加強(qiáng)知識(shí)產(chǎn)權(quán)保護(hù)的重大決策部署,充分宣傳知識(shí)產(chǎn)權(quán)工作進(jìn)展成效,推出一批自主創(chuàng)新典型,引導(dǎo)各地各行業(yè)增強(qiáng)創(chuàng)新發(fā)展動(dòng)力;組織開(kāi)展知識(shí)產(chǎn)權(quán)宣傳周等各項(xiàng)宣傳活動(dòng)。

77.在義務(wù)教育課程標(biāo)準(zhǔn)教材修訂中強(qiáng)化知識(shí)產(chǎn)權(quán)教育內(nèi)容,在高中思想政治教材修訂過(guò)程中充實(shí)有關(guān)知識(shí)產(chǎn)權(quán)教育的內(nèi)容,鼓勵(lì)引導(dǎo)高校加強(qiáng)知識(shí)產(chǎn)權(quán)專(zhuān)業(yè)建設(shè),開(kāi)設(shè)知識(shí)產(chǎn)權(quán)相關(guān)領(lǐng)域的輔修課程,開(kāi)展知識(shí)產(chǎn)權(quán)普及教育。

78.指導(dǎo)卓越法律人才教育培養(yǎng)相關(guān)基地繼續(xù)加強(qiáng)高素質(zhì)知識(shí)產(chǎn)權(quán)專(zhuān)業(yè)人才培養(yǎng)工作,加強(qiáng)知識(shí)產(chǎn)權(quán)人才培養(yǎng)基地的建設(shè)。

79.做好打擊侵犯知識(shí)產(chǎn)權(quán)和制售假冒偽劣商品工作的宣傳報(bào)道,公開(kāi)曝光一批被查處的知識(shí)產(chǎn)權(quán)侵權(quán)案例,強(qiáng)化知識(shí)產(chǎn)權(quán)知識(shí)法制宣傳和誠(chéng)信宣傳。

80.大力實(shí)施廣播影視精品工程,扶持內(nèi)容創(chuàng)作生產(chǎn),提高影視劇、動(dòng)畫(huà)片、紀(jì)錄片的原創(chuàng)能力,發(fā)展廣播影視新興業(yè)態(tài),增強(qiáng)多元化供給能力。

八、提高知識(shí)產(chǎn)權(quán)戰(zhàn)略組織實(shí)施水平

目標(biāo)任務(wù):以推進(jìn)完成《國(guó)家知識(shí)產(chǎn)權(quán)戰(zhàn)略綱要》五年任務(wù)目標(biāo)為核心,加強(qiáng)知識(shí)產(chǎn)權(quán)戰(zhàn)略實(shí)施工作體系和平臺(tái)建設(shè),開(kāi)展知識(shí)產(chǎn)權(quán)戰(zhàn)略五年目標(biāo)全面評(píng)估,開(kāi)展知識(shí)產(chǎn)權(quán)戰(zhàn)略先進(jìn)評(píng)選表彰工作,舉辦知識(shí)產(chǎn)權(quán)戰(zhàn)略實(shí)施推進(jìn)會(huì)議和專(zhuān)題宣傳活動(dòng),推動(dòng)知識(shí)產(chǎn)權(quán)戰(zhàn)略工作深入開(kāi)展。

Promotion Plan for the Implementation of the National Intellectual Property Strategy in 2013

Office of the Inter-Ministerial Joint Meeting for Implementation of the National Intellectual Property Strategy

This plan is promulgated to implement the requirements of the 18th National Congress of the Communist Party of China (CPC), carry out the innovation-driven development strategy, promote the realization of the five-year goals of the Outline of the National Intellectual Property Strategy, identify the primary goals and measures for the implementation of the national intellectual property strategy in 2013.

I. Enhancing Intellectual Property (IP) Creation

  Goals:

Raising the quality of intellectual property rights (IPRs) and innovation efficiency; improving the relevant examination management, i.e, patent, trademark, copyright, new plant varieties, etc., improving the IP performance evaluation system, encouraging the IP creators to transfer their focus from the quantity to the quality; and upgrading the IP value.

Measures:

(1) Implement the revised evaluation index system for the State Technological Invention Award, improve the requirements on IP certifying documents for candidate projects of the Award, and steer the evaluation experts towards the quality, as well as the transfer and application, of the IP rights of the candidate projects.

(2) Perfect the assessment and evaluation system for patent index and the system for IP statistics index; carry out evaluation on the index of “invention patent number per ten thousand people.

(3) Refine the systems for operation instructions and quality guarantee in patent examination; improve the patent searching capacity; draft policies designed to enhance the patent quality, clarify the orientation of patent subsidizing policy and raise the performance of the policy; strengthen the monitoring and handling of abnormal patent applications, standardize patent applications.

(4) Improve the trademark examination standards, complete the 3rd stage construction of the Trademark Registration and Management Automation System, enhance the trademark registration efficiency, ensure the trademark registration and examination pendency below 10 months and the disagreement review pendency below 18 months.

(5) Strengthen the copyright registration, improve the system for collection, submission and publishing of copyright registration data, enhance copyright registration volume and its coverage.

(6) Formulate and improve the testing guidelines and examination regulations on new varieties of plants, raise the capacity of examining and testing, achieve a better management of new varieties of plants examination, improve the quality of the granted new varieties of plants.

II. Strengthening IP Layout in Key Industries

Goals:

Promoting the integration of IP and industry policies, strengthening the IP risk assessment and warning in strategic emerging industries and industries with regional advantages, reinforcing the guidance to the IP layout in key industries, guiding the industries and enterprises to enhance their capacities of leveraging IPRs in global competition.

Measures:

(7) Implement the Opinions on Strengthening the Intellectual Property Work in the Strategic Emerging Industries by the General Office of the State Council, improve coordination mechanisms, formulate and implement the working plan for the IP work of strategic emerging industries for 2013.

(8) Implement the Regulations on the Preferential Examination of Invention Patent Applications, provide preferential examination for patent applications in strategic emerging industries like energy saving and environmental protection, the new-generation information technology, biology, high-end equipment manufacturing, new energy, new materials, as well as the technologies supporting a green development, such as low-carbon technologies and resources-saving technologies.

(9) Improve the copyright statistics system, carry out the annual survey on the contributions of copyright-related industries to national economy, strengthen the instruction and management of copyright trading.

(10) Explore the construction of a national IP appraisal mechanism, further the pilot programs for IP appraisal in major economic, scientific and technological activities by central enterprises, scientific research institutes and local governments to improve their capacities of conducting IP analysis and appraisal, and delivering relevant service.

(11) Further implement the Risk Assessment and Warning Project for Industrial Intellectual Property , provide IP warning for the selected key industries demanding industrial transformation and upgrading, carry out IP mapping and analysis in key technical fields, promote a market-oriented operation of IP in key industries.

(12) Carry out pilot projects of patent-oriented development and patent mapping in selected industries; organize 10 patent mapping and warning projects in key industries and technical fields; launch 10 research projects on industrial IP analysis, dissemination, and promotion; review Handbook on Practical Patent Analysis and formulate Standards on Patent Analysis Report.

III. Promoting IP Utilization

Goals:

Strengthening the key role by enterprises in IP utilization, improving the transformation and commercialization mechanism for IP-linked and IP-based innovations, implementing the policies facilitating IP transformation and the transfer to enterprises, promoting the materialization, commercialization and industrialization of IP rights.

Measures:

(13) Implement a number of pilot projects on innovation development and application of key industries, promote the materialization, commercialization and industrialization of self-relied IP rights in the large-scale commercialization of next-generation internet and LTE industry development, promote the integration of IPRs and standards in digital television, next-generation mobile communications, next-generation internet technology, etc.

(14) Study and formulate guiding opinions on promoting the technology transfer in research institutes and universities, experiment with technology transfer in model institutes to encourage research institutes and universities to establish standardized IP management system and technology transfer mechanism.

(15) Comprehensively implement the Project on Enhancing IP Utilization Capacities of Industrial Enterprises, support the local implementation of the project by confirmation, assistances and rewards, study and formulate the Guidelines for IP Management by Industrial Enterprises, provide guidance on IP management by pilot enterprises.

(16) Implement the promotion program for the industrialization of forestry patents and granted new varieties, promote the transfer and utilization of advanced forestry patents and new varieties.

(17) Accelerate the mutual transfer of military and civil IPRs, initiate the establishment of an IP management system featuring the feasibility assessment, a system of submission, utilization and management of the technique documentation from equipment procurement, as well as a management system of military software copyright, innovate the IP transfer and transformation model, promote the utilization of the IP rights relating to national defense.

(18) Refine policies on IP investment and financing, formulate guiding opinions on IP pledge and loans by commercial banks, build 20 IP investment and financing service platforms, implement a pilot project on integrating IP licensing right, stock right, and other assets.

IV. Reinforcing IP Protection

Goals:

Refining IP-related laws and regulations, improving the long-term mechanism of combating IP infringement according to the law, implementing the performance evaluation of IP protection. Enhancing the effectiveness of judicial IPR protection and the capacity of administrative enforcement, implementing the special protection operations and assistance programs for key fields and industries, promoting the information disclosure of IP cases subject to administrative penalty. Strengthening the protection of IP resources in the fields with traditional advantages, enhancing the ability of dealing with international cases.

Measures:

(19) Accelerate the revision of Trademark Law, Copyright Law, Patent Law as well as relevant implementation regulations.

(20) Provide stronger protection for the innovative pharmaceutical, initiate study on policy and legislation on innovative pharmaceutical protection.

(21) Draft and promulgate the Measures on Copyright Supervision and Administration of Films and Videos on Internet, and the Guiding Opinions on Copyright Enforcement.

(22) Revise the Several Provisions on Issues Concerning Applicable Law in the Trial of Patent Disputes (2001), formulate Interpretation on Several Issues Concerning the Applicable Law in IP Attachment before the Institution of an Action, Interpretation on Several Issues concerning the Applicable  Law in the Trial of Trademark Civil Disputes, and Interpretation on Several Issues Concerning the Applicable Law in the Trial of Trademark Granting and Confirmation Cases; promulgate in a timely manner the guiding opinions on issues concerning the applicable laws in the patent infringement disputes, patent granting and confirmation, protection of well-known trademark, protection of service trademark, copyright disputes relating to the Kara OK business operators.

(23) Moderately increase the number of grass-roots people’s courts with jurisdiction of general IP cases, assign more intermediate people’s courts to the jurisdiction of first-instance IP cases, further the pilot program of integrating civil, administrative and criminal cases in one IP court, optimize the judicial coordination mechanism; improve the organizational structure of the grass-roots people’s courts, implement the brand court project.

(24) Implement the performance evaluation of local governments on combating infringements and counterfeits, formulate relevant performance evaluation system.

(25) Formulate the instruction documents on publishing legal information concerning infringement and counterfeit cases subject to administrative punishment, promote the disclosure of case information by relevant administrative enforcement authorities.

(26) Continue to promote the working mechanism linking administrative and criminal enforcement, complete the development of information-sharing platform before the end of the year, and supervise the administrative enforcement authorities to transfer a number of suspected criminal cases.

(27) Urge governments at municipal and county level to accomplish the inspection and improvement involving application of licensed software before the end of 2013, comprehensively promote the application of licensed software in enterprises, complete the pilot projects on software assets management in enterprises.

(28) Improve the supervision and management on the pre-installation of legitimate software in new computers, promote the application of safe and controllable legitimate softwares, promote the combination of the application of legitimate software and informationization in governmental agencies.

(29) Organize the anti-counterfeiting campaign with focus on 5 crimes hindering the innovative development of enterprises, baffling the stimulation of domestic demand and employment, damaging public health, endangering manufacturing and living security, and jeopardizing food security and farmers’ interests.

(30) Investigate and punish websites involved in copyright infringement and the disseminating information of counterfeited and shoddy goods, disclose enterprises accessing internet without authorization, work on effective methods for strengthened domain name information supervision, raise the information accuracy of the registered websites.

(31) Implement the 9th Swordnet campaign against online copyright piracy, implement the special rectification on infringement and piracy involving online literatures, music, videos, games, animation and software.

(32) Strengthen the proactive supervision of website copyrights with focus on application software websites, shopping websites, and video websites.

(33) Launch the Project on Enhancing Patent Enforcement, promote the establishment of enforcement teams, confirmation and consultation centers for patent infringement, coordination centers for patent administrative enforcement, promulgate and implement the detailed opinions on implementing the Decisions on Enhancing Patent Administrative Enforcement, set up a target-oriented accountability system for enforcement, promote and guarantee the enhanced capability for patent administrative enforcement.

(34) Enhance the IPR protection in specialized marketplaces, promote the promulgating of Several Opinions on Enhancing the IPR Protection in Specialized Marketplaces, promote the capacity for IPR protection in specialized marketplaces; establish and improve the self-discipline mechanisms in industries, provide assistance to IPR protection by industrial associations.

(35) Establish a number of express IPR protection centers in key areas and industries, establish express protection mechanism to deliver efficient service to enterprises and industries, explore and establish consultation centers for patent infringement confirmation.

(36) Refine the regulation system against trademark infringement, promote the establishment of information platform for the trademark administrative enforcement, organize special actions, supervise the handling of a number of major and serious cases, especially those concerning the well-known trademarks, international trademarks, geographical indications, increase penalty for “Free ride of brand”, including the unlicensed use of packing or decorations of well-known products.

(37) Improve the long-term mechanism for trademark protection, speed up the drafting of plan to promote the trademark licensing operation in large-scale retail enterprises and famous brand shops in large and intermediate cities, increase the efficiency of regular supervision.

(38) Strengthen the IPR protection by customs, carry out special enforcement actions in key areas and against key products, deepen the enforcement cooperation among customs to jointly combat the infringement in international trade, increase the technical input in zhong IPR protection by customs for more efficient enforcement.

(39) Carry out bilateral and multilateral international IP exchanges and cooperation, lead and participate in bilateral and multilateral IP negotiations, actively promote the negotiation on Sino-Euro Agreement on Geographical Indications, closely follow and participate in the formulation of international IP rules, actively showcase the accomplishments of IPR protection in China.

(40) Enhance assistance to enterprises in foreign-related IP lawsuits, put into full play the overseas IPR protection and aid centers for enterprises; improve the IP risk assessment and pre-warning for the major export industries and relevant enterprises in international trade.

(41) Promote China’s accession to the Hague Agreement Concerning the International Registration of Industrial Designs administered by the World Intellectual Property Organization (WIPO)。

(42) Provide stronger protection for the forest new varieties of plants, initiate the establishment of a DNA fingerprint database for the forest new varieties of plants, e.g. Chinese rose.

(43) Enhance the registration and protection of geographical indication and agricultural product trademarks, put forward the trademark enriches farmers project, and promote the construction of new countryside.

(44) Promote the construction of demonstration areas for geographical indications protection, enhance the protection and regulations of the import and export products with geographical indications, promote the import and export of geographical indication products and the development on global market of the industry.

(45) Investigate and explore the geographical indication resources of agricultural products, carry out the tracking and monitoring of the quality and safety of agricultural products with geographical indication.

(46) Promote the legislation process of the Regulations on the Access to and Benefit-Sharing of Genetic Resources, develop relevant policies and mechanisms managing the access and benefit-sharing of genetic resources.

(47) Initiate the Study on the Protection of the Traditional Knowledge of the Traditional Chinese Medicine, promote the establishment of traditional Chinese medicine knowledge specification, conduct survey on the traditional Chinese medicine knowledge resources, so as to provide source materials for the documenting and compiling of protection list of traditional Chinese medicine knowledge.

(48) Implement the Study on the IP Protection of National and Folk Arts, incorporate the protection and management of IP into Chinese folklore resource management system, and therefore provide an operational IP solution for Chinese folk literature databases.

V. Improving IP Management Capacity

Goals:

Developing policies to strengthen IP management, improving IP management system and coordination mechanism, stepping up collaborative, regulatory, and proactive management of IP, improving IP management efficiency, enhancing the capacity and level of scientific IP management by various stakeholders.

Measures:

(49) Develop policies for strengthening IP management, refine IP management system and mechanism, and enhance the IP management capacity of governments, industries, businesses, universities, research institutions and service agencies.

(50) Study and revise policies and documents related to IP management in colleges and universities, improve the IP management system, and enhance the capacity of IP management in colleges and universities.

(51) Implement the Interim Provisions on IP Management of Major National Science and Technology Projects , urge each project to speed up the formulation of IP management rules in line with its specific characteristics, improve the registration, statistics collection and evaluation system of IP information of major national science and technology projects, strengthen the supervision, assessment and guidance.

(52) Refine the Regulations on Strengthening IP Management of the National Science and Technology Programs, invite IP experts to participate in performance assessment of the national science and technology programs, strengthen the IP statistics collection and assessment in key areas of the national science and technology programs, and promote the publication of achievement information of the science and technology programs.

(53) Strengthen the IP management of major cultivation projects of genetically modified new varieties of organism, study and draft relevant IP management measures, provide regulative IP-related guidelines on R D and industrialization of genetically modified new varieties of organism.

(54) Study and develop instruction documents for the implementation of IP strategy by the cultural system, strengthen the guidance on their IP work.

(55) Innovate the working mechanism for trademark administrative guidance, establish a system providing classified guidance for the implementation trademark strategy, encourage and guide the market entities to formulate and implement their own trademark strategies based on their own development requirements.

(56) Improve the IP management mechanism for radio, film and television, strengthen precautions against the legal risks in radio, film and television, promote the construction of IP management criterion by radio and television stations at all levels, focus on the promotion of copyright contract demonstration text of radio stations and television stations, promote the construction of media asset management system at radio stations or television stations, guide the Radio and Television Copyright Commission under China Radio and Television Association to strengthen industrial self-discipline, improve internal mediation mechanism for disputes among members and the collective right protection mechanism.

(57) Draft and promulgate the Regulation on the Remuneration for the Statutory License of Textbooks, amend and promulgate the Regulations on Remuneration for the Published Written Works.

(58)  Strengthen the supervision and management of copyright collective management agencies, develop specific systems for their open, transparent and legal operations.

(59) Carry out pilot projects on copyright asset management in publishing industry, initiate a study on copyright asset management system and mechanism, study and draft guiding documents for copyright asset management in cultural businesses.

(60) Publish the national standard of the Enterprise Intellectual Property Management, develop measures for the determination of enterprises with IP (patent) advantages, and carry out the cultivation of enterprises with IP advantages in selected provinces.

(61) Study and develop IP management standards or guideline by Chinese Academy of Sciences, further standardize the IP management in scientific research institutes, draft Measures for Intellectual Property Management of Scientific Research Projects, promote pilot project on establishing whole-process IP management system in key scientific research projects.

(62) Refine the working system for national defense IP, guide relevant IP mapping and scientific layout, introduce integrated IP management pilot to the innovator, strengthen the IP management in equipment procurement contracts, and initiate the construction of the invention reporting system.

(63) Recruit high-end talents from those studying abroad for implementing IP strategy, through various projects, e.g. the Funding Project for Returned High-level Talents, the Advanced Funding Programs for Scientific and Technological Project for Returned Talents, and the Overseas Chinese Serving the Country Action Plan; together with the Project of Supporting the Start-ups established by Returned Talents, offer special support to returned talents who are establishing hi-tech start-ups with self-developed IPRs; improve the different preferential policies for returned high-level talents, to foster a better environment for high-level IP talents and support them to play their roles.

(64) Study and formulate Opinions on Strengthening the Construction of Intellectual Property Talent System, implement Hundred and Thousands of IP Talents Project, conduct the evaluation of one hundred high-level talented training candidates, continue to step up the training of thousands and ten thousands of professionals; launch the program of establishing national IP training bases, develop Opinions on Strengthening the Work of National Intellectual Property Training Bases, implement the informationization project for IP personnel.

VI. Developing IP Service Industry

Goals:

Improving the management system of IP service industry by implementing related policies, strengthening the construction and utilization of the fundamental IP information resource, guiding IP service agencies to expand business, training high-end IP service talents, cultivating and promoting the development of IP service industry.

Measures:

(65) Implement the Guidance on Speeding up the Cultivation and Development of IP Service Industry, introduce corresponding policies, establish a mechanism for conducting census and monitoring IP service activities and publishing relevant information, promote the construction of IP service industry cluster, cultivate well-known IP service agency.

(66) Organize and implement special program for high-tech service industry, take IP service industry as a preferential and guiding sector with support.

(67) Promote the revision of Regulations on Patent Commissioning, advance the development promotion and pilot programs for the industry, and comprehensively carry out practical skills training for patent agents.

(68) Implement the Administrative Measures for Law firms in Trademark Commissioning, implement the registration and other related work for law firms engaged in the trademark commissioning business, strengthen the supervision and administration of the commissioning by trademark agencies, promote the standardized trademark legal service.

(69) Support and encourage lawyers to provide legal service for patent commissioning, experiment with patent attorney system in patent commissioning industry, make efforts to cultivate and develop more patent attorneys in trademark and patent commissioning industries, so as to provide better patent-related legal services.

(70) Promote the establishment of model cities, institutions, zone (base) of copyright, strengthen the guidance and management of copyright trade, and provide support to relevant agencies in the mediation and arbitration of copyright disputes.

(71) Promote the integration of IP judicial appraisal into the unified registration management, specify the professional classification for IP judicial appraisal, improve the technical specifications and standards of IP judicial appraisal, further raise the level of standardization and occupational competence of the IP judicial appraisal expertise, support and cultivate a number of highly qualified and high-level IP judicial appraisal institutions.

(72) Expand the geographical distribution of patent insurance pilot projects, develop patent insurance categories, and build an innovative mechanism for patent insurance service with various participants.

(73) Implement the Plan on the Construction of National Patent Public Service System, establish a national system for the macro-management and guidance of dissemination and utilization of patent information, and support the local deliverance of tailored patent information services to industries with own characteristics.

(74) Build up IP integrated data platforms for industries, construct case databanks for patent research and analysis in key technical fields such as semiconductor lighting and new energy vehicles, the information databanks for software copyright and layout design of integrated circuit, as well as the IP warning databanks for key industries.

VII. Strengthening IP Culture Development

Goals:

Strengthening the dissemination of IP knowledge, the training of personnel, the inclusion of IP in school education, fostering an IP culture climate of respect for knowledge, advocation for innovation, integrity and legal observance”, strengthening the supportive role of IP in the development of cultural industries, provide support to the integration and development of IP in major fields like press, radio, film and television, literature and art, etc, promoting the rapid flourishing of cultural industries.

Measures:

(75) Promote the IP culture development program, promulgate the Guiding Opinions on Strengthening the Development of IP Culture.

(76) Aggressively disseminate the important decisions by the 18th National Congress of the CPC on the implementation of IP strategy and the strengthened IPR protection, showcase the IP achievements, introduce best practices of independent innovation, encourage local governments and industries to provide stronger impetus to innovation, organize various dissemination events including the National IPR Publicity Week.

(77) Introduce more IP materials into the amendment of the textbook for compulsory education and the ideological and political textbooks for high schools, encourage colleges and universities to set up IP disciplines, and to provide minor IP-related courses, carry out universal IP education.

(78) Guide the high-level legal education training bases to strengthen the training of quality IP professionals, step up the development of training bases for the IP professionals.

(79) Publicize the progresses in combating against IP infringement and the producing and selling of counterfeits and shoddy goods, make public cases in which the IP infringements were investigated and punished, strengthen the dissemination of IP legal information, and encourage integrity.

(80) Further implement the project of producing excellent radio programs, films and television programs, encourage the content creation and production, improve the capacity of producing original television dramas, cartoons and documentaries, develop new business models for radio, film and television, enhance diversified supply capacity.

VIII. Improving the Organization and Implementation of IP Strategy

Goals:

Taking the realization of the five-year goals established in the Outline of the National Intellectual Property Strategy as the core objective, strengthening the construction of working system and platform for the implementation of IP strategy, implementing comprehensive assessment on the five-year goals of the IP strategy, carrying out the evaluation and selection of the best performers in implementing the national IP strategy, convening conference on promoting the IP strategy, holding special publicity activities, deepening the IP undertaking.

Measures:

(81) Carry out the evaluation on the accomplishment of the five-year goals of the Outline of the National Intellectual Property Strategy.

(82) Select and award the best performers in implementing the national IP strategy.

(83) Organize national publicity activities for the 5th anniversary of implementing the national IP strategy, showcase the achievements and experiences accumulated in IP over the past 5 years, and arrange press reports on the relevant commemorative activities.

(84) Convene conference on promoting the implementation of national IP strategy, strengthen the construction of the working system and platform for implementing the national IP strategy.
